Woman arrested, charged in upstate bicycle crash

Earlier this month, a 39-year-old man from Petersburg, New York, was riding his bicycle on Route 22 when he was apparently hit from behind by a Hoosick Falls woman. State police believe she had been driving under the influence of drugs and potentially texting when she smashed into the bicyclist. Now, the 37-year-old woman is in jail while the man remains in critical condition in the Albany Medical Center.

Not only did the woman get behind the wheel while supposedly impaired by drugs and was believed to be texting, but she also left the bicyclist lying in the road and drove off. The woman seems to have returned home after accident and, when asked by a relative where all the damage to her car had come from, she was unable to give an answer. Luckily, that family member contacted police.

Now that the family of this man knows who hit him, they may chose to file a personal injury lawsuit against her. If police and prosecutors can prove what they are alleging, the family members may be able to hold this woman responsible for his serious injuries, medical costs and other costs arising out of this crash. Since he was in no way responsible for the accident, he should not have to cover his own costs.

Following the accident, the man was airlifted to Albany Medical Center. He had been thrown nearly 30 yards from his bike. He had also sustained a massive trauma even with his helmet.

While these criminal charges will certainly help the bicyclist, a civil suit would provide him with money that he likely needs.
