Costco injury ends in $415,000 award for customer in slip and fall

Go into any New York Costco and you will see a giant warehouse filled with products and people. Even though it may be busy, you expect that the floors will be cleaned of spills and that there won't be anything dangerous on which to slip and fall. Unfortunately, that does not always happen, and when there is a dangerous substance on the floor, it opens the company up to liability if an Albany customer falls and injures him- or herself.

A recent Costco customer sustained a shattered kneecap when she slipped and fell in some liquid soap that seems to have spilled on the floor. The woman was at an out-of-state Costco in the food court portion of the store nearly three years ago when she fell. Since that time she needed an expensive surgery to wire her kneecap back together.

At no time since the accident has Costco acknowledged any responsibility in the accident and never once tried to settle. Even though the woman's lawyer presented evidence that employees had walked by the puddle only a few minutes before the accident, not one cleaned it up. Because big stores like Costco may be reluctant to admit their responsibility in accidents such as these, it is important to get an experienced premises liability attorney to aggressively pursue a case if you are ever injured in a slip and fall accident.

After almost three years of fighting for compensation for her medical expenses and her pain and suffering, a jury has finally awarded her almost $415,000. The unanimous jury vote encompassed both past and future expenses.

It is always upsetting when a store or business fails to follow its own procedures and makes the premises unsafe for patrons. People going through a store should not have to worry that they are going to fall on something that has spilled or trip on uneven flooring.
