The law firm Dreyer Boyajian LLP has filed a class action lawsuit against Glens Falls Hospital, Portal Healthcare Solutions LLC and Carpathia Hosting, Inc. for the unauthorized disclosure of patient medical records on the internet.
According to Glens Falls Hospital, the medical records of over 2,300 patients were available on the internet via an unsecured computer server between November 2 and March 14. The publically disclosed records included transcribed doctor office notes, which typically include a patient's medical diagnoses, clinical laboratory results, diagnostic imagining reports, emergency department records, medication administration and other treatment. In a letter to affected patients, the hospital stated that its forensic auditors concluded that some of the records may have been accessed or downloaded. As a result of the data breach, the hospital terminated the services of its medical records contractor, Portal Healthcare Solutions LLC.
Prior to correcting the problem, a patient's record could be accessed by simply "Googling" the name of the patient on the internet. The Google search would result in a returned link with the patient's name, which when clicked, revealed the patient's medical records with all of the vital personal information for that patient. The file was in a downloadable format, and could be viewed, printed or saved by anyone with an internet connection without any password or security protection.
The class action lawsuit seeks money damages for the 2,300 patients of Glens Falls Hospital's health centers and physician practices affected by the data breach, expenses associated with identify theft and credit monitoring services, and injunctive relief compelling the hospital to identify and retrieve any medical records that were accessed or downloaded.
