Girl awarded multimillion-dollar medical malpractice award

When you are sick, you go to the doctor and he or she prescribes you some kind of medicine. Whether it is over the counter or a prescription medication, you generally trust your doctor's diagnosis and treatment. There may be some people in Troy who will question whether the doctor has made a medication error, but, for the most part, people outside of medicine or pharmacology don't have enough knowledge to really know whether a prescription is right or not. When there is a problem, however, a medical malpractice lawsuit may be an appropriate way to seek compensation for the damage the medication error caused.

And that is what the family of a young girl did after she was left with a serious brain injury. The lawsuit paid off and the girl was recently awarded $15.2 million to cover her care for the rest of her life.

Five years ago, the then-4-year-old was in the hospital because of a heart defect when she developed a cold. Because of a lack of communication between her cardiologists, she was prescribed a nasal spray that ended up blocking the flow of oxygen to her brain, causing the brain injury. Although the girl's parents could have questioned the use of the spray, how would they have known what would have happened? Unless they were medically trained, they likely would have no clue a nasal spray could cause such a serious injury.

Since her injury, the girl has had tremendous setbacks. She is no longer able to walk or talk and cannot swallow on her own. This jury award will make it much easier to ensure her needs are met throughout her lifetime.
