Six Flags Great Escape Lodge & Indoor Waterpark Outbreak
Class Action Lawsuit Filed
On March 28, 2008, the law firm of Dreyer Boyajian LLP filed a class action complaint against Six Flags, Inc., as owner and operator of the Great Escape Lodge & Indoor Waterpark resort in Queensbury, New York. The resort has been linked to a suspected Norovirus outbreak which has resulted in gastrointestinal illness suffered by over 400 visitors of the waterpark.
The action was filed on behalf of three Rensselaer County residents in the New York State Supreme Court for Rensselaer County and alleges, among other things, that the operators of the Great Escape Lodge & Indoor Waterpark failed to act promptly to prevent the spread of the outbreak and to warn patrons, when it had reason to know, that it was in the midst of a viral outbreak.
Norovirus Outbreaks
Norovirus is usually characterized by nausea, vomiting, diarrhea and abdominal pain. Lethargy, weakness, muscle aches, headaches and fever may also occur. Symptoms may persist for several days and in the case of the elderly and immuno-compromised, the illness can become life threatening if dehydration is ignored or left untreated. The lawsuit will seek compensation for damages including medical expenses, lost wages, as well as for pain and suffering caused by the illness.
