Seneca State Park Sprayground
Dreyer Boyajian LLP has been appointed Co-Class Counsel in a class action lawsuit against the State of New York arising from an outbreak of the waterborne parasite cryptosporidia at the Seneca Lake State Park in Geneva, New York. The claimants allege that the outbreak was the result of contaminated water from the Spraypark, a water play facility consisting of over 100 water jets that spontaneously spray water over a hardtop surface. The State of New York, which owns and operates the park, disputes any liability.
Status of Litigation - Updated April 1, 2008
On June 29, 2006, the New York State Court of Claims certified a class action on behalf of 663 persons whom had filed suit. The court subsequently approved the mailing of Notices and Claim Forms to approximately 3,500 persons who contacted New York health public health agencies to report a cryptosporidosis illness together. Notices were also published in various newspapers. On March 31, 2008, the class notice period closed. The parties are presently engaged in discovery. The court has not set a trial date.
